Terms of Service

These Terms of Service (“Terms”) govern your use of Churro (“Service”), operated by Churro (“we”, “us”, “our”). By using our Service, you agree to these Terms.

1. Service Description

Churro is an automated content generation and publishing platform. We generate SEO-optimized articles for your website using AI technology, including research, writing, editorial review, and fact-checking. Articles are published to your connected CMS (WordPress, Shopify, Wix, Webflow, or Ghost).

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One account is intended for one individual or business entity.

3. Subscription and Billing

  • Churro offers paid subscription plans billed monthly or annually.
  • Prices are listed on our pricing page and may be updated with 30 days notice.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • All payments are processed securely through Stripe.
  • You may cancel your subscription at any time through your account settings or Stripe billing portal.

4. Free Trial and Cancellation

30-Day Free Trial

  • All new subscribers receive a 30-day free trial on their chosen plan.
  • A valid payment method is required to start the trial, but you will not be charged until the trial period ends.
  • You may cancel at any time during the trial. If you cancel before the trial ends, your card is never charged.
  • After the 30-day trial, your subscription automatically begins at the plan price you selected.
  • The free trial is available to first-time subscribers only and cannot be used repeatedly.

Cancellation After Trial

  • You may cancel your subscription at any time through your account settings or the Stripe billing portal.
  • Monthly subscribers: your access continues until the end of your current billing cycle. No refunds for partial months.
  • Annual subscribers: your access continues until the end of your annual term. No refunds for unused time.
  • No prorated refunds are offered after the trial period.

Upgrades and Downgrades

  • Upgrades take effect immediately. You are charged the prorated difference for the remainder of your current billing period.
  • Downgrades take effect at the start of your next billing cycle. You keep your current plan's features until then.
  • Switching from monthly to annual billing takes effect immediately at the discounted annual rate.

5. Content Ownership and License

  • You own all content generated by Churro for your account. We do not claim any ownership rights over your generated articles.
  • You grant us a limited license to process and publish content on your behalf to your connected CMS platforms.
  • We may use anonymized, aggregate data about content performance (not the content itself) to improve our service.
  • You are responsible for the content published on your website, including compliance with applicable laws.

6. Content Quality and Limitations

  • We strive to generate accurate, well-researched content but do not guarantee the accuracy of all information.
  • Our fact-checking process verifies claims against available sources but is not infallible.
  • We do not guarantee specific search engine rankings, traffic levels, or business outcomes.
  • SEO results depend on many factors outside our control, including your website's domain authority, competition, and Google's algorithms.
  • You should review published content and verify critical facts, especially in regulated industries (legal, medical, financial).

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or to generate content that violates laws.
  • Resell, redistribute, or white-label generated content as your own content service without a Business plan.
  • Attempt to reverse-engineer, copy, or replicate our content generation pipeline.
  • Use the Service to generate spam, misleading content, or content intended to deceive.
  • Exceed your plan's article limits through automated means or multiple accounts.

8. CMS Integration

  • You are responsible for providing valid CMS credentials and maintaining your website's availability.
  • We are not responsible for issues caused by your CMS platform, hosting provider, or third-party plugins.
  • You may revoke our publishing access at any time by disconnecting your CMS in account settings.

9. Data and Privacy

Our handling of your data is described in our Privacy Policy, which forms part of these Terms.

10. Limitation of Liability

  • The Service is provided “as is” without warranties of any kind.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
  • Our total liability is limited to the amount you paid us in the 12 months preceding any claim.
  • We are not responsible for changes in search engine algorithms that affect your content's rankings.

11. Termination

  • You may terminate your account at any time by cancelling your subscription.
  • We may suspend or terminate your account for violation of these Terms with 7 days written notice.
  • Upon termination, your generated content remains on your website. We delete your account data within 30 days.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
